Information Text Regarding the Processing of Personal Data within the Scope of the Personal Data Protection Law
a) Data Controller and Representative
As KLINIKER MEDICAL INDUSTRY AND FOREIGN TRADE as, we process your personal data within the limits set by other legislation within the framework of the Personal Data Protection Law explained below.
In this context, your personal data will be processed by our departments in part or in whole through non-automatic ways, or as part of any data recording system: obtained, recorded, stored, preserved, modified, reorganized, disclosed, transferred, acquired, made available, classified, transferred to third parties or institutions, and transferred abroad.
b) Purposes and Conditions for Processing Personal Data
Your personal data is processed for various purposes and conditions by our business units: to provide you with the necessary services and products offered by our company, planning and/or execution of market research activities for the sale and marketing of products and services, planning and/or execution of after-sales support activities, monitoring of contract processes and/or legal claims, ensuring the legal, technical, and commercial security of related individuals in business relationships, implementation of human resources policies of our company, evaluation upon job application, ensuring quality control of products and services provided, tracking of procured products, establishing contact with you upon requesting information from our company, performance of sales or service contracts upon purchasing products or services, suggestions of products and services by our company, planning and execution of corporate communication activities, fulfillment of legal and statutory obligations if you are an employee of our company, ensuring security when visiting our company, planning, auditing, and executing information security processes, establishment and management of information technology infrastructure, planning and execution of logistics activities, determining and implementing commercial and business strategies of our company, tracking financial and/or accounting matters, tracking legal affairs, planning and executing company activities. These data processing activities are carried out based on legal obligations, legitimate interests, and explicit consent where necessary under the law.
c) Purpose and Conditions of Personal Data Transfer, Transferred Parties
Your personal data is transferred to our business units for necessary works related to benefiting from the products and services offered by our company; ensuring the execution of our company's human resources policies; ensuring the legal and commercial security of individuals/institutions involved with our company; being necessary for the establishment and direct execution of contracts and under legitimate interest conditions; personalized offerings of our company's products and services according to your needs with explicit consent; determination and application of our company's commercial and business strategies under legitimate interest conditions; transferred to our business partners, suppliers, shareholders, affiliates, legally authorized public institutions, and private individuals.
d) Transfer Abroad
Your personal data is transferred to servers abroad in communications established through digital means. In any case, your data will be kept in safe countries determined by the Personal Data Protection Board.
e) Method of Collecting Personal Data
Your personal data is collected by our company through various channels and different legal bases within the framework of our company's commercial purpose; contacting us through various means, establishing and executing a contractual relationship with our company, visiting our company, third parties providing your information to us for establishing contact for commercial activities, sharing information at events like fairs, education, conferences, through different channels and legal bases for the commercial purpose of our company, collected to develop the products and services we offer and to conduct our commercial activities.
f) Duration of Retention of Your Personal Data
Your personal data, which we process in accordance with the Personal Data Protection Law No. 6698, will be deleted, destroyed, or anonymized by our Company in compliance with the Regulation on the Deletion, Destruction, or Anonymization of Personal Data and other relevant legislation by default or upon your request, once the reasons requiring processing have ceased. Our responsibilities under various legislations such as financial consultancy, independent audit regulations, CMB, TCC, and other regulations requiring us to retain your personal data are reserved.
g) Your Rights under Article 11 of the KVKK and Your Application
As the data subject within the scope of Article 11 of the KVKK:
Right to Information / Learning: The right of data subjects to learn whether their personal data is recorded by the data controller, if so, what it includes, the right to access including the submission of approved methods, the purposes for which these are recorded, and whether they are used appropriately for these purposes, whether they are transferred to third parties, and/or abroad,
Right to Rectification: The right to request the correction of personal data if it is incomplete or incorrectly processed, even by the recipients,
Right to Erasure: The right to request the lawful destruction of personal data, even by the recipients,
Right to Object to the Result: The right to object if an adverse result occurs solely through the analysis of personal data by automatic systems,
Right to Compensation for Damages: You have the right to request compensation for damages if data subjects suffer damage due to the unlawful processing of personal data.
As a related party, if you submit your requests related to the abovementioned rights to us, our company will conclude the request within the shortest and no later than thirty days depending on the nature of the request. If the process requires a fee, our company will inform you that the fee specified by the Personal Data Protection Board may be charged. Your application will be responded to by our company, complying with all our responsibilities within the scope of the Communiqué on Application Procedures and Principles to the Data Controller and the Law No. 6698, ensuring all formal and procedural requirements are met.
